Venice Stakeholders Informs City Attorney With Legal Opinion Stating Ocean Front Walk Is A Park

As expected, a neighborhood group has weighed in with the City Attorney stating that per their legal analysis, Ocean Front Walk is part of the City Park system, and therefore not subject to the Jones Act. This has already been brought to the attention of the City and as we understand it, the City is already on the cusp of making this clear in an official statement, which has been in the works for a while. This means that Park rules apply to the sidewalk area of Ocean Front Walk, which in turn means no sleeping or camping ( and a host of other goodies we will detail in an upcoming story this week including no smoking, and no dogs anywhere in the park ).     If this is already in the works to be made official why are they sending a letter? Seems like a waste of paying a lawyer, unless it is just typical Venice neighborhood grand-standing.

    As a resident along Ocean Front Walk near Thornton, I have contacted every entity within the city about the transients, not to mention that I can’t see the ocean from my ocean front property - all I see are vendor booths that are so cram packed with garbage I can’t see the beach. I am well aware of the politics that is needed to get things to change. It seems the city entities that have to deal with this like the police and the parks have it adequately addressed. They are just waiting for it to be official so they don’t get sued. It was disappointing to see so few people at the meeting yesterday regarding the ordinance that so importantly impacts the park and our living conditions. All of the legal representation from the City on these issues were in attendance, and answered many questions including officially designating the boardwalk as part of the park which is already in process. The issue for me is are they going to enforce this? Not “kind of”. Will they really enforce it?

    I don’t understand, I thought this used to be in place? - so I guess during the last decade some PC inclination basically lowered the bar and allowed people to sleep and defecate and generally “filthify” Ocean Front Walk. There used to be no overnight camping on the beach, etc., etc. and somewhere along the way the restraints were loosened.

    With the way human mindset is these days, the drugs, the total discontent, homelessness, joblessness and so forth, leaving this area open for people to roam at night - leaves it totally exposed to crime. Besides that, the urine smell is just increasing daily - I am a Venitian and I hardly ever go down there any longer - it makes me want to puke if not run and hide.

    As a resident of Venice near the beach for going on 10 years, I have watched the scene deteriorate and it breaks my heart. I find traversing my neighborhood after dark terrifying. Since the stabbing death of a pregnant resident by one of the boardwalk ilk I’ve stayed up on the sex offender database registrants and there are more than a few living on the strand.
    It is not that the Police do nothing. Every Thursday - Sunday they conduct a warrant sweep of the area. On average they arrest upwards of 200 people with outstanding warrants. Its like shooting fish in a barrel.
    The passage of the draft ordinance amending Los Angeles municipal code section 42.15 to restrict vending, regulate performing and prohibit generating excessive noise on beaches or upon immediately adjacent boardwalks, sidewalks and public ways would only make things worse. The vendor thugs are the only people keeping the peace down there. When the lottery system went into effect, the vendors had reserved spaces and didn’t sleep on the street as they do now. It was great for vendors but horrible for residents as the homeless flooded the area.
    I am all for cleaning up the boardwalk and enforcing section 63.44 is the best way to start.
